​If an individual passes away without an estate plan, or if certain assets are left out of the estate plan, it is necessary for the assets to be probated to transfer title according to state law or the wishes of the decedent.

Estate planning is all about protecting your loved ones, which means in part giving them protection from the Internal Revenue Service (IRS).
